The member of the Constitution Drafting Assembly (CDA) Nadia Omran said there are legal alternatives that don’t go at odds with the constitutional declaration, pointing out that they will be in use if the House of Representatives (HoR) fails to issue a law for a referendum on the constitution.

Omran indicated that the alternatives include issuing a decree from the executive authority or a legislation from the High National Elections Commission (HNEC).

“The HoR doesn’t want to issue a referendum law and prevent Libyans from exercising their rights. Since September 2017, when the constitution’s final draft was approved by the CDA, we informed the HoR to start working on a referendum law, yet up until now there is no law.” Omran explained.

She added that all legal and political activists should back up one of the legal alternatives so a referendum law can be issue for Libyans to exercise their right to vote in approval or disapproval of the constitution, citing the UNSMIL’s speedy push for elections before the referendum on the constitution.

“We all know the repercussion of entering into a new transitional phase.” Omran added.

Meanwhile, the CDA finished the draft of the constitution a year and a half ago and passed it to the HoR for them to issue a referendum law, however; the HoR has been protracting the issuing of the law, according to many observers and parties, wishing to go to elections directly because the current constitution draft excludes certain individuals, including Khalifa Haftar.
